1. TERMS AND CONDITIONS OF USE

1.1. The website “www. hikingcomolake.com” (“Site”) is the exclusive property of Francesca Mai, with registered office in Cernobbio, Via Piave, 29, Italy.

1.2. Access to and navigation on the Site by individual users are free of charge and subject to acceptance of the terms and conditions of the services and this legal notice.

1.3. The user acknowledges and agrees: (i) that Francesca Mai reserves the right to modify the terms and conditions of this legal notice at any time, by communicating the changes to users by a general notice placed on the Site or by a link to such notice; and (ii) that, from the time when such general notice is placed on the Site, the amended legal notice shall replace the terms and conditions, with access to and navigation on the Site being subject to such new terms and conditions (this legal notice, as amended from time to time, shall hereinafter be referred to as “Legal Notice”). 

2.  INTELLECTUAL PROPERTY RIGHTS

2.1.  The contents of the Site, such as, but not limited to, works, images, photographs, dialogues, music, sounds, videos, texts, and any further material in any format, including, but not limited to, menus, web pages, graphics, colours, schemes, tools, fonts, designs, diagrams, layouts, methods, processes, functions and software (individually and/or collectively referred to as “Contents”), and the related distinctive signs and/or logos are the exclusive property of Francesca Mai or, in any case, in its exclusive availability, and may in no case be used in any way and/or form without the prior written consent of Francesca Mai.

2.2. The “HIKING COMO LAKE” trademarks and logos, including the domain name “hikingcomolake.com”, are the exclusive property of Francesca Mai.

2.3. These trademarks, logos and domains may not be used in any way without the prior written consent of Francesca Mai. 

3.  LINKS TO OTHER WEBSITES

3.1. The Site may contain text links (the “Links”) to other websites that have no connection with the Site. Francesca Mai does not control or monitor such websites, their contents or their rules.

3.2. Any link to other websites shall not, in any way, be construed as an activity carried out by Francesca Mai to promote such websites and/or the content published therein.

3.3. Therefore, users visit and use such websites that can be accessed from this Site through links under their sole responsibility and in their sole discretion.

3.4. This legal notice, therefore, only applies to Francesca Mai’s Site and the services offered therein, and not to any other websites that may be visited by users through links. 

4. COOKIES

4.1. The Site may contain session “cookies” (which are not stored permanently on the user's computer and disappear when the browser is closed) and third-party cookies, in order to provide users with a better use of the Site. 5. DATA PROCESSING - PRIVACY

5.1. As the Data Controller, Francesca Mai guarantees that any data received by e-mail and/or through electronic registration forms are processed in accordance with the provisions of current legislation on Privacy (GDPR no. 2016/679).

5.2. To access some of the services provided through this Site, users may be asked to fill in some forms containing personal data (such as, but not limited to name, surname, and e-mail address). Any request for services by the user (such as the request for information and/or booking a specific trip and/or tour) involves the acquisition by Francesca Mai of the data necessary for the provision of such services.

5.3. The Privacy&Cookie Policy of the portal HIKING COMO LAKE by Francesca Mai is available on the Site, and further specific information may be published on the pages of the Site set up for particular on-demand services. The content of the above privacy notice can be updated based on subsequent changes in legislation on privacy and/or in the purposes for which the data are processed. Any substantial change shall be promptly communicated to users by the Date Controller by publishing the updated text on the Site.  

6. LIMITATION OF LIABILITY

6.1.  The user acknowledges and agrees that their access to and browsing of the Site is entirely at their own risk and under their sole responsibility.

6.2. The user also acknowledges and agrees that the Site is provided “as it is” and “as it is made available”, and that it may be temporarily inaccessible or otherwise contain defects or be delayed.

6.3. Francesca Mai does not assume any responsibility for the content, the materials and/or the information entered by users on the Site in the special virtual spaces that Francesca Mai makes them available for interacting with the Site (“User Content(s)”).

6.4. Francesca Mai shall not be liable for any loss or damage arising out of or in any way connected with the use or operation of the Site, including - without limitation - damages for loss of business, loss of profits, business interruption, loss of business information and/or any other type of pecuniary loss, except in cases of wilful misconduct or gross negligence by Francesca Mai.

6.5. Francesca Mai does not guarantee that the Site is free of errors or viruses, and therefore Francesca Mai and its suppliers are not responsible for any damages suffered by the user due to such harmful elements. 

7. REPORTING OF ABUSE

7.1. Users who have noticed any User Content that they consider unlawful, inappropriate, offensive or rude are encouraged to promptly report it to Francesca Mai by email at the address maifrancesca@pec.it, while entering “Reporting Abuse” in the subject line.

7.2. Users are encouraged to act with responsibility when reporting abuse. You will be deemed responsible for any reports that prove to be unfounded and/or illegitimate. 

8. APPLICABLE LAW

8.1. This Legal Notice is governed by Italian law.
